WHAT IS THE SW® CARD?

The SW® Card is an international rechargeable debit card that allows you to manage cryptocurrency from the SW® platform.

COMMISSION

  • The SW® Card commission is 3%.

  • Monthly fixed rent for maintenance.

REGULATORY FRAMEWORK

The SW® Card will be governed by the provisions issued by regulatory bodies and authorities authorized to supervise its operation in the territory of the Bolivarian Republic of Venezuela.

ISSUANCE

The SW® Card is the property of CCSCEX | CARACAS COMMODITY EXCHANGE®, who only transfers its use under the conditions established in this document and for the specific purpose for which it was granted.

As the holder of the SW® Card, you are the custodian of the card and should be responsible for its proper use and custody. If any merchant affiliated with the Visa network requires the use of the card, it is recommended that you request its destruction in your presence to avoid unauthorized use.

It is important to note that the SW® Card is non-transferable, and CCSCEX | CARACAS COMMODITY EXCHANGE® will not be responsible for the use that third parties may make of your username, password, PIN, and card. Therefore, it is necessary to take care of them and not to deliver them to third parties.

At the time of issuing the SW® Card, the card numbers and security code will be provided to make online transactions with merchants. If you want to request the physical version of the SW® Card, you can do so through our website and define the place of delivery.

It is essential to highlight that the SW® Card can only be delivered to the account holder, and the presentation of an original identification document will be required for its reception.

CCSCEX | CARACAS COMMODITY EXCHANGE® reserves the right to request additional documentation and information from the applicant and/or beneficiary before issuing the SW® Card to comply with local anti-money laundering, terrorism financing, and financing of the proliferation of weapons of mass destruction (AML/CFT/FPADM) regulations, as well as any other additional requirements that CCSCEX | CARACAS COMMODITY EXCHANGE® may demand to meet the objectives envisaged by the regulations.

OBLIGATIONS AND RESPONSIBILITY

Terms of Use for the SW® Card:

  • The SW® Card can only be used for lawful purposes and in accordance with the current and future Terms and Conditions of Use.

  • It is the user's responsibility to maintain the confidentiality of the SW® Card number.

  • In case of loss or theft, the user must immediately notify the phone number indicated on the back of the SW® Card or through the website.

  • The user must present their identification document at the time of using the SW® Card in commercial establishments.

  • CCSCEX | CARACAS COMMODITY EXCHANGE® does not guarantee uninterrupted access to the channels for using the Virtual and/or Physical SW® Card, which may not be available due to technical difficulties, internet failures, network unavailability, or any other reason, even outside of CCSCEX | CARACAS COMMODITY EXCHANGE®'s control.

  • The user releases CCSCEX | CARACAS COMMODITY EXCHANGE® from any liability for direct damages, lost profits, or any other damage or harm that may arise from transactions with the SW® Card.

  • The costs, fees, and commissions associated with the SW® Card and its operation will be the responsibility of the user.

  • CCSCEX | CARACAS COMMODITY EXCHANGE® reserves the right to make changes and modifications to the Terms and Conditions of Use at any time, simply by publishing the modifications through the website. All modifications will come into effect the day after their publication. The user must notify CCSCEX | CARACAS COMMODITY EXCHANGE® by email of their rejection of the modifications within 5 (five) days of publication. Otherwise, it will be considered that the user has accepted such modifications.

  • The handling and safekeeping of the SW® Card plastic and the funds available in it are the sole responsibility of the user.

REGARDING THE OPERATION WITH THE SW® CARD:

To enable the SW Card, the user must access the CCSCEX | CARACAS COMMODITY EXCHANGE® website. The SW® Card can only be used for lawful transactions and in accordance with the Terms and Conditions of Use, which include:

  • Acquiring goods or services from establishments adhered to the network of merchants, both in the country and abroad, through POS terminals or other data transmission means.

  • Transferring funds to another user(s) of the SW Wallet®.

  • Withdrawing funds in cash at enabled withdrawal points.

  • Any other use enabled by CCSCEX | CARACAS COMMODITY EXCHANGE®.

It is important to note that the SW® Card is only a means of payment and does not imply any relationship between CCSCEX | CARACAS COMMODITY EXCHANGE® and the operations carried out by the user with the merchant. For this reason, operations with the SW® Card cannot be revoked or canceled, except in exceptional cases provided by law. Any claim related to goods or services acquired with the SW® Card must be directed directly to the merchant.

Each transaction made with the SW® Card will reduce the available balance in the SW Wallet®. The user cannot make transactions for an amount greater than the balance available in the SW Wallet® at any time. The available balance can be checked on the CCSCEX | CARACAS COMMODITY EXCHANGE® website.

The limit of use of the SW® Card will depend on the loaded and available balance in the SW Wallet® at any time. If for any reason a transaction is approved without sufficient balance, the user must reimburse the amount to the SW Wallet® within a maximum period of 24 hours, expressly authorizing CCSCEX | CARACAS COMMODITY EXCHANGE® to debit the corresponding amount once the balance in the SW Wallet® is verified.

LOADS AND RECHARGES

To comply with the financial regulations of the Bolivarian Republic of Venezuela, CCSCEX | CARACAS COMMODITY EXCHANGE® reserves the right to establish limits on the load and recharge balances of the SW® Card, using any means available for that purpose.

It is important that the user knows that the receipt signed by them and the corresponding settlements, as well as any electronic or digital receipt issued by the Merchant in previously authorized transactions, will serve as proof of their operations and the amount of these.

It should be noted that the SW® Card does not allow purchases in installments or installments.

CCSCEX | CARACAS COMMODITY EXCHANGE® reserves the right to immediately cancel an SW® Card if misuse or fraudulent use is detected, or if there is evidence of suspicious movements that could indicate a violation of the current regulations against money laundering, terrorism financing, and financing of the proliferation of weapons of mass destruction (ML/TF/WMD), or other applicable provisions.

Once the SW® Card is enabled, the holder may make recharges for the amounts and channels that CCSCEX | CARACAS COMMODITY EXCHANGE® has enabled or incorporates in the future. These details will be reported on the website or through other means, such as social networks or email. The limits set by the company cannot be exceeded.

The new balance will be available within a maximum period of 72 (seventy-two) business hours, depending on the means used to make the recharge. The commission for recharge will be established in the Annex of Commissions, which CCSCEX | CARACAS COMMODITY EXCHANGE® will publish in the future and which will be deducted from the new available balance. The maximum amount in monthly recharges cannot exceed the limit reported to the user on the website or other means at the time of recharge.

REGARDING INFORMATION ON OPERATIONS

The user can verify the operations carried out with the SW® Card by consulting their SW Wallet®. This information will include the charges, costs, and commissions generated in the period consulted.

LOST, STOLEN OR MISSING SW® CARD

In case of loss, theft, duplication, or breach of the security of the SW® Card, the user must immediately notify CCSCEX | CARACAS COMMODITY EXCHANGE® by sending an email to hello@sw.exchange.com. Upon receiving the notice, CCSCEX | CARACAS COMMODITY EXCHANGE® will immediately disable the SW® Card so that it cannot be used.

The user will be solely responsible for any consumption made with the lost, stolen, or missing SW® Card up to 24 hours prior to notification to CCSCEX | CARACAS COMMODITY EXCHANGE®. If the user omits the notification process, they will be responsible for all purchases made with the lost, stolen, duplicated, or compromised SW® Card, until its expiration or until it is recovered by CCSCEX | CARACAS COMMODITY EXCHANGE®.

If the SW® Card is recovered after notifying CCSCEX | CARACAS COMMODITY EXCHANGE®, it cannot be used, and a new SW® Card must be issued. CCSCEX | CARACAS COMMODITY EXCHANGE® will automatically issue a new SW® Card and deliver it according to the established delivery methods. Available balances from the reported SW® Card will be transferred to the new SW® Card. The cost of replacement will be deducted from the available balance of the SW® Card and, if there is no balance available, a new SW® Card will be issued anyway. The applied costs will be deducted when making the first load.

REPRINTING DUE TO DAMAGED SW CARD

In case the SW Card® is damaged and needs to be reprinted, the user must request a reprint through the CCSCEX | CARACAS COMMODITY EXCHANGE website. The cost of the reprint can be found in the Commission Annex. This cost will be deducted from the available balance on the card and will be based on the value established in the current or future Commission Annex. If there is no available balance, the SW Card® will be replaced anyway, and the applied costs will be deducted when the first load is made.

VALIDITY AND/OR RENEWAL OF THE SW CARD®

The SW Card® is valid until the expiration date indicated on the plastic and cannot be used after that date. If the user wishes to renew it, they must request it through the CCSCEX | CARACAS COMMODITY EXCHANGE website. The renewal will be automatically processed unless the user indicates otherwise.

For automatic renewal, the SW Card® must have had activity in the previous 12 (twelve) months before the renewal process. If there has been no activity, CCSCEX | CARACAS COMMODITY EXCHANGE® will cancel the SW Card®. The renewal cost will be deducted from the available balance on the SW Card®. If there is no available balance, the renewal of the SW Card® will still be carried out, and the applied costs will be deducted when the first load is made.

During the validity of the SW Card®, the Terms and Conditions of Use established in this document will apply, as well as any other condition established in the future.

TAXES

The user will be responsible for paying all current and future taxes that directly or indirectly affect the SW Card® as well as expenses related to it, such as issuance, maintenance or consumption. These taxes will be debited from the balance of the SW Card®. If the SW Card® does not have sufficient balance to cover the applicable taxes, CCSCEX | CARACAS COMMODITY EXCHANGE® will contact the user through the website, social media or email to inform them how to proceed with the payment.

CANCELLATION OF THE SW CARD®

Before requesting the cancellation of the SW Card®, the user must ensure that there is no balance on the card. If the SW Card® is cancelled by decision of CCSCEX | CARACAS COMMODITY EXCHANGE® and it has an available balance, it will be refunded according to what is established in due time.

JURISDICTION AND COMPETENCE

Any dispute that may arise in connection with this Agreement or that may arise from the use and operation of the SW Card® must be resolved in the ordinary courts of the City of Caracas, Venezuela.

By accepting these Terms and Conditions, the user acknowledges and accepts them in their entirety.
