ELIGIBILITY
By creating an account on SW PAY and using any of its services, the user confirms that they have read, understood, and accepted the user agreement terms and conditions, as well as the privacy and law enforcement policies, acknowledging that they accept being subject to these agreements and policies.
The user, by accessing or using SW Pay, declares and warrants that: They will not use SW PAY for any illegal activity, including but not limited to illegal gambling, money laundering, fraud, blackmail, extortion, data ransom, terrorism financing, and other violent activities.
RESTRICTIONS
RESTRICTED ACTIVITIES
The following activities are restricted:
Violating (or assisting any other party in violating) any applicable law, statute, ordinance, or regulation.
Intentionally attempting to defraud (or assisting in defrauding) CCSCEX | CARACAS COMMODITY EXCHANGE® or other Users.
Providing false, inaccurate, or misleading information.
Taking any action that interferes with, intercepts, or expropriates any system, data, or information.
Engaging in any transaction involving the proceeds of illegal activity.
Transmitting or uploading any virus, worm, or other malicious software or program.
Attempting to gain unauthorized access to other SW PAY accounts, the SW PAY website, or any related network or system.
Using SW PAY on behalf of a third party or acting as an intermediary between the Company and any third party.
Collecting any user information from other Users, including but not limited to email addresses.
Defaming, harassing, or infringing upon the privacy or intellectual property rights of the Company or any other User. Uploading, displaying, or transmitting messages, photos, videos, or other media that contain illegal or copyrighted images or materials.
UNAUTHORIZED TRANSACTIONS
The use of SW PAY is prohibited in relation to the following, and CCSCEX | CARACAS COMMODITY EXCHANGE® reserves the right to monitor payments or transactions relating to:
Any restricted person or persons or entities located in restricted territories.
Money laundering, terrorism financing, or financing the proliferation of weapons of mass destruction.
Any kind of Ponzi scheme, pyramid scheme, or multi-level marketing program.
Goods or services that infringe or violate any copyright, trademark, or property rights under the laws of any jurisdiction.
Evading trade, insider trading, use of privileged information, market manipulation, or other forms of market-based fraud or deception.
Any activity that the Company has reason to believe is illegal in the Bolivarian Republic of Venezuela.
IMPORTANT: In the event that CCSCEX | CARACAS COMMODITY EXCHANGE® becomes aware that you are engaging in such prohibited transactions, CCSCEX | CARACAS COMMODITY EXCHANGE® will consider it a violation of these Terms and Conditions and may suspend or cancel your access to SW PAY.
ACCOUNT CLOSURES OR SUSPENSIONS
SW PAY by CCSCEX | CARACAS COMMODITY EXCHANGE® cannot close or suspend user accounts, it can only alert competent authorities in the following cases:
If the user has engaged in transactions with blacklisted accounts or has engaged in prohibited activities and transactions, which will be reported to competent authorities.
Court order or order from any Regulating Entity in the Bolivarian Republic of Venezuela.
Important
The user may terminate this Agreement at any time by closing their account on SW PAY. Such closure may be avoided if, in the judgment of CCSCEX | CARACAS COMMODITY EXCHANGE®, it is being done in an effort to evade a court order or legal investigation. Following the closure or suspension of a SW PAY account, the user authorizes CCSCEX | CARACAS COMMODITY EXCHANGE® to cancel or suspend pending transactions, forfeiting all property rights and claims. The user remains responsible for all activities performed on or with their SW PAY account by CCSCEX | CARACAS COMMODITY EXCHANGE® while it was active and for all amounts owed under this Agreement.
VALIDITY
These TERMS and CONDITIONS are declared effective as of the date of their publication (January 2023) on the website https://ccscex.com
